Is Delta-9 Legal in Alabama?

The 2018 Farm Bill, signed by President Donald Trump, legalized hemp cultivation. As a result, all derivatives, cannabinoids, extracts, and isomers derived from hemp are federally legal.

Alabama followed this bill and, in 2018, revised Section 2-8-381 of the Code of Alabama 1975 through the Alabama Senate Judiciary Committee. These revisions legalized industrial hemp and hemp products, while distinguishing hemp from marijuana.

(3) HEMP PRODUCTS: Refers to products made from industrial hemp, including cloth, cordage, fiber, food, fuel, paint, paper, particleboard, plastics, seed, seed meal, seed oil for consumption, and seed for cultivation, provided the seeds originate from industrial hemp varieties.

(4) INDUSTRIAL HEMP or HEMP: Includes the plant Cannabis sativa L., including its seeds and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers. It must be cultivated or possessed by a licensed grower or in accordance with the state's USDA-approved regulatory plan. The delta-9 tetrahydrocannabinol concentration should not exceed 0.3 percent on a dry weight basis. Industrial hemp is considered an agricultural crop or commodity under state law, excluding marijuana as defined in subdivision (14) of Section 20-2-2.

What's Delta-9 THC?

Delta-9 THC (Delta-9-tetrahydrocannabinol) is one of the many cannabinoids found in hemp and marijuana. Hemp can provide over 113 naturally occurring cannabinoids, with CBD, Delta-9, and Delta-8 being the most common in production.

Delta-9 is the most well-known form of THC and is often referred to as simply "THC." Its name comes from the chemical bond on its ninth carbon chain, distinguishing it from Delta-8, which has a bond on its eighth carbon chain.
